These Terms and Conditions ("Terms") are a binding agreement between you ("Member," "you") and ELUSSO PTY LTD (ABN 16 663 480 153) ("ELUSSO," "we," "us").
These Terms govern your access to and use of the elusso.au website (the "Site") and all services provided by ELUSSO, including your membership subscription, access to partner perks, and entry into any giveaways (collectively, the "Service").
By creating an account, purchasing a membership, or using our Site, you agree to be bound by these Terms. Please read them carefully.
1. Your ELUSSO Membership
Eligibility: You must be 18 years or older and a resident of Australia to become an ELUSSO member and be eligible for giveaways.
Account: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Membership Tiers: We offer several monthly membership tiers ("CORE," "SUPER," "ULTRA") and a "Limited" pass. The specific inclusions, benefits, and pricing for each tier are detailed on our Memberships page. We reserve the right to modify these tiers at any time.
2. Billing, Payments, and Cancellations
Subscription: Our "CORE," "SUPER," and "ULTRA" memberships are recurring monthly subscriptions. By purchasing, you authorize us to charge your chosen payment method automatically each month on your billing date.
Billing Cycle: Your membership fee will be billed at the beginning of your subscription period and will automatically renew each month unless you cancel.
Cancellations: You may cancel your recurring membership at any time through your account dashboard in the Members Area or by contacting us at support@elusso.au. Your cancellation will take effect at the end of your current paid billing cycle. You will retain access to member benefits until that time.
Refunds: Membership payments are non-refundable. We do not provide refunds or credits for any partial-month membership periods or unused perks.
Price Changes: We reserve the right to change our membership pricing. We will provide you with at least 30 days' notice of any price changes before they take effect.
3. Prize Giveaways & Promotions
Eligibility: All active, paid members are automatically entered into our prize giveaways, subject to the specific rules of each promotion. You must be an Australian resident and 18+ to win.
How to Enter: Your membership tier determines your number of entries into each giveaway, as specified on our Memberships page.
Accumulating Entries: "Accumulating entries" (for SUPER and ULTRA tiers) are bonus entries that are added to your total for each month you remain an active, paying member, increasing your chances over time. These entries are voided if your membership is cancelled.
Draws and Winner Notification: Winners are selected via a random draw. Winners will be contacted directly via phone and/or email from winner@elusso.au and announced on our Site and social media.
Promotion Rules: Each giveaway is a separate trade promotion and is governed by its own specific set of rules and "Terms and Conditions," which will be made available on the giveaway page.
Permits: Our giveaways are conducted in accordance with Australian law with emit obtained in all relevant states/territories.
4. Partner Perks & Third-Party Services
Third-Party Offers: As a member, you get access to exclusive discounts, offers, and services from our third-party partners ("Partners").
Our Responsibility: ELUSSO does not control and is not responsible for these Partners or their offers. We act as a platform to connect you with them. Any transaction, service, or agreement you make with a Partner is solely between you and that Partner.
Disclaimer: We do not warrant the quality, accuracy, or availability of any Partner perks. Offers are subject to change or removal at any time without notice.
5. EV Charger Installers
A Connection Service: ELUSSO helps members find and connect with pre-vetted, trusted EV charger installers.
Disclaimer of Liability: We are a referral and connection service only. The installation service itself is a separate agreement between you and the installer. ELUSSO is not a party to that agreement and is not liable for any work, damages, warranties, or disputes that may arise from the installation.
6. Community Events
Assumption of Risk: Your participation in any ELUSSO community event (such as drive days, track days, or meetups) is at your own risk.
Liability Waiver: You understand that driving and track-based activities carry inherent risks. To the fullest extent permitted by law, you release ELUSSO, its founder, and its employees from any and all liability for any injury, loss, or damage you may suffer during these events.
Code of Conduct: You agree to behave safely and respectfully at all events, follow all instructions from event staff, and adhere to all road and track rules.
7. Intellectual Property
All content on our Site, including the ELUSSO name, logo, text, graphics, and images, is our exclusive property and is protected by copyright and trademark laws. You may not use our brand or content without our express written permission.
8. Limitation of Liability
To the fullest extent permitted by law, ELUSSO is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, your membership, or your interaction with any third-party Partners or installers.
9. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts in that state.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on this page and, where appropriate, notifying you by email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
